Welcome to Locaisle ("Locaisle", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of https://www.locaisle.com (the "Service"), and work together with our Privacy Policy at https://locaisle.com/privacy.html ("Privacy Policy"). By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use Locaisle. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration and Authentication

a. Account Creation

To access certain features, you may be required to create an account. When you sign in using Google Authentication, we collect your Google account email address, name, profile picture (if available), and a unique identifier associated with your Google account. We use this information solely to create and manage your Locaisle account. We do not access additional Google services beyond basic profile information needed for authentication.

You agree to:

  • Provide accurate and complete information;
  • Maintain the security of your account;
  • Notify us immediately of unauthorized access.

b. Google Authentication

By signing in with Google, you authorize Locaisle to access your basic profile information as described in the Privacy Policy. We comply with Google API Services User Data Policy, including requirements about transparency and limited use of Google user data.

3. Use of the Service

You agree to use Locaisle only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations;
  • Infringe intellectual property or privacy rights;
  • Attempt to interfere with the Service's security or operations;
  • Use the Service for fraudulent or harmful conduct.

4. Intellectual Property Rights

All content, features, and functionality of the Service—such as text, software, designs, and graphics—are owned by Locaisle or its licensors and protected by intellectual property laws. Use of the Service is governed by a limited, non-exclusive, non-transferable license for personal or internal business purposes.

5. User Content and Data Usage

a. User Content

If you provide content through the Service ("User Content"), you retain ownership of that content.

b. License to Locaisle (AI & Analytics)

By submitting User Content, you grant Locaisle a worldwide, non-exclusive, royalty-free, sublicensable license to:

  • Use, host, store, reproduce, modify, and display User Content;
  • Create derivative works;
  • Analyze, aggregate, anonymize, and process User Content;
  • Use it to operate, improve, and develop the Service, including training AI models.

This license is necessary to provide and improve your experience on Locaisle, consistent with the Privacy Policy's description of how we monitor, analyze, and use data.

c. Aggregated and Anonymized Data

We may generate aggregated and anonymized data from User Content and use it for analytics, research, and improvement of the Service. This behavior reflects how we use information to "monitor and analyze trends" as described in the Privacy Policy.

6. How We Use Your Information

Your use of the Service and any personal information we collect is governed by the Privacy Policy. That includes using data to:

  • Create and manage accounts;
  • Provide, maintain, and improve the Service;
  • Analyze user behavior to optimize the platform;
  • Detect fraud and illegal activity.

10. Termination

11. Disclaimers and Limitations

The Service is provided "AS IS" and "AS AVAILABLE." We make no warranty regarding accuracy, completeness, or reliability, consistent with the Privacy Policy's disclosures about data security.

12. Limitation of Liability

To the fullest extent permitted by law, Locaisle's liability is limited to the greater of:

  • The amount paid by you in the last 12 months; or
  • $100 USD

13. Arbitration and Class-Action Waiver

Any dispute shall be resolved through binding arbitration, and you waive the right to participate in class actions, consistent with industry expectations for consumer applications.

14. Export Controls

You may not use the Service in violation of U.S. export control or sanctions laws.

15. Governing Law

These Terms are governed by Washington state law, without regard to conflict of laws.

16. Changes to These Terms

We may update these Terms. Changes become effective on posting with an updated date. Continued use constitutes acceptance.
